Ok I had just left Macys in Glendale around 7:10 PM and was planning on taking Meridian home but the traffic was so bad I decided to take Guilford heading south … as I am driving down I Guilford approach three four way stops…. So I stop look left look right. While waiting for the ambulance this lady goes "IM a witness" so the officer goes one moment ill be with you in a min.’s then the nurse is holding my head and neck and then help arrives they had to cut me out of the car. And no IM not fat IM 5 11 155 anyhow they take me to Methodist Hospital (keep in mind being an Episcopalian I was not happy of the fact I was going to a Methodist Hospital and knew John and Charles Wesley would of been upset too) and I was wishing we had an Episcopal Hospital) they got me there and I arrived in the trauma center and went on to run test and come to the conclusion they have to keep me overnight because my red blood cell count was very low going through my spleen so after about 50 hours from arriving things are back to normal and they let me go home… well to make this to the point the witness phone-number that made this so called statement was disconnected ! That said I failed to yield I was told my another officer that it means her statement is not valid… i myself have total damage of over 100 k including hospital lost work time etc. i was driving a saturn she was driving im guess her mom or dads unless she is rich a 2009 GMC GMC Envoy… i called an lawyer and they said if the police report says it was my fault then that settles it… Am I screwed or does anyone know a lawyer willing to listen to my side of the story and not just a witness they cant even get ahold of… someone please help! Just an FYI this girl driving the envoy was 18 and I think she was texting or not paying attention or whatever because she T BONED me and didn’t even TRY and avoid me as any normal person would do without even thinking about it…

ok maybe i went overboard but the point im trying to make is yes i know she may of had the right of way BUT she could of been texting , looking around the car etc…. what im trying to get at is that if she was that good of driver she would of done anything to avoid the accident and when i pullled out after stopping SHE WAS NOT THERE she seemed to come out of no were and keeep in mind the trees the shrubbery and the cement wall
So…..once you cut through all the cr@p that has nothing to do with nothing…(your gastic by-pass 2 years ago, a methodist hospital etc, she is 18, she is driving her parents vehicle, witness phone number disconnected, the fact your 5’11" and 155lb).
What it boils down to is you pulled up to an intersection that turns out to be a 2 way stop. You had a stop sign. The car on the cross street did not have a stop. You stopped at the stop sign and pulled out into the path of the on coming vehicle.
Of course your car got t-boned. That’s what happens when you pull out in front of someone.
Although you told us a bunch of junk that has nothing to do with the accident…..you never told us that you SAW the other car before you pulled out. I take that to mean that you did not see the other car before you pulled out from the stop sign.
You are at fault for this accident.
You had a stop sign. The other driver did not. You had a duty to make sure the way was clear before you pulled out from the stop sign. You did not meet this duty.
You had a duty to keep a safe lookout. Since you never said you saw the car befor pulling out… I take it that means you did not see the car and therefore did not ful fill this duty either.
The witness is not the make or break problem here. The stop sign is. All a lawyer has to do is go to the intersection….see you had a stop sign and the other car did not. And you’re case is toast.

You used an abundance of unneeded words in your question. But the bottom line is this. YOU pulled out into traffic without making sure the way was clear, and the car that hit you had the right of way. A "normal person" shouldn’t have to avoid you, since you shouldn’t have been there in the first place. A "normal person" would know not to proceed without making sure the way was clear. The accident is your fault, your insurance will pay for damage you did to the other car, and any medical bills belong to you since you are the one at fault.
Contact your insurance company and make arrangements to have the damage you caused paid for. Contact an attorney if you like, they will tell you the same thing for a price that I just told you free.
She came out of somewhere and you didn’t see her which was your responsibility to do before you pulled out. It was your fault and you are going to have to deal with it. How do you know the other driver "might" be doing something like texting,etc. since you never saw that driver until you was hit. You just can’t make things up to make yourself look better. The same accident just happened to my close friend when a 16 year old boy pulled out in front of her and she had no choice except to hit him. She doesn’t make much money, has no family, is on her own, and her good running car was old but in excellent shape. Her car was totaled in the accident. The rich kids insurance paid her only a fraction of what her car was worth and she could not buy another car that ran good for what they gave her. She has no car, lost her job because of it and is practically homeless now on account of this accident that was not her fault. She could only afford insurance that was "limited tort" which means she cannot sue. I have no sympathy for you at all when I see what happened to her. I hope the other driver is OK and gets everything back they lost from your bad driving.
